1. Sign-Up & Account creation conditions
By accessing this website, the user exercises its right to act in a complete autonomous manner and guarantees its full authority, aptitude and right to agree with the proposed agreement.
User accept all terms and conditions related to the use of this website and confirms he/she is over 18. The transfer and exchange of accounts between individuals or entities is strictly forbidden. A « user » is defined as an individual who has duly completed the subscription form and indicated forst, last name, address, email address, date of birth, citizenship and a contact number. When user's information change, it is user's responsibility to update the account. Each user, by signing up, agrees to the following restrictions :
Should bid-dream find cohersion between users in order to « fix » bids and auctions, i twill immediately shut down all accounts associated with such action, without the possibility of refunds.
2. User name and Password
Upon signing up, you will be prompted to create a user name and password. This will enable you to log in, manage your account and place bids. You are solely responsible for the safe storage. Should you lose it or feel that it is being used illegally, please contact us at privacy@bid-dream.com immediately to reset it. Pure Move, bid-dream.com and its employees are not responsible for the miss-use of your user name and password when it has been obtained illegaly by a third party.
3. Access without signing-up
Bid-dream.com may provide you access to the website and certain services without requiring signing up. Those areas and services are accessible at www.bid-dream.com and include all pages not prompting the use of a user name and password.
4. Condition, duration and protection of the user
This Agreement will remain in force as long as you make use of this website. You may cancel your subscription by erasing your profile, at any given time, for any reason. Please follow the removal instructions as set forth in the ACCOUNT section of the website.

We reserve the right to cancel your membership at any time.
To prevent credit card fraud, we reserve the right to require a copy of your credit card to match the information entered at time of CREDIT purchase. Abusive use of credit cards will be regarded as an attempt to defraud this website and its owners, and will be prosecuted to the fullest extent of the law.
We may cancel and/or suspend your account for one or more of the following reasons :
The suspension of any accounts may cause all ongoing bids for that account to be suspended, especially if it is determined that a specifc bid or product was won using fraud or price fixing techniques. In such cases, legal action may be commenced against the user.
Should mis-handling of the system be suspected after the win was delivered to the user, return of all wins will be demanded and must be done within 10 days after receipt of the notification. Unless the win is not restituted to Pure Move/Bid-dream.com, litigation through a collection agency will be commended. In addition, the company will regard any suspected accounts as liable for a 5.000,00 euros fine. By using our system, you understand those terms and conditions and accept the possible fines should your account be suspected of mis-use or fraud.
5. Services
Pure Move/Bid-dream.com reserves the right to select service providers and limits those to the listing on www.bid-dream.com at the time of the win.
6. Credits
Your access to the site and your subscription are free. To be able to use the services of www.bid-dream.com and place bids, you must purchase what we call « credits ».
You must also accept the fact that such credits, once purchased, can't be refunded even in part.
7. Modifications of Service
Bid-dream.com reserves the right to constantly improve its website and the experience it provides its customers. We will always do our best to send notifications, however it may also do so without any notice. It is your responsibility to check our terms and conditions on a regular basis to ensure your full knowledge of all rules of use. No refund will be issued for purchased « credits » unless our service is closed/interrupted for 12 or more consecutive months.

The bid-dream.com trademark and the logo of bid-dream.com as well as the content of this website are property of Pure Move SA. All other marks are property of their respective owners. In no manners, ways, shape or forms registered trademarks, intellectual property of bid-dream.com and/or contents and images must be copied, reproduced or distributed without receiving prior written authorization from Pure Move SA.
9. Electronic communication
By subscribing and using this website, you agree to receive e-mails from bid-dream.com. In addition, you agree and accept that bid-dream.com may choose to communicate with you by other means based on the information you provided on the registration form. You agree that all electronic communications received by/through bid-dream.com, and such until the cancelation/closing of your account will not be regarded as unwanted, bulk or junk mail.
10. External Links, products & services.
Our website may, from time to time, promote suppliers and other partners products, services and websites. Pure Move SA/bid-dream.com is not affiliated with those websites and is not responsible for their activities and policies with respect to their products and services.
You agree not to hold Pure Move SA/bid-dream.com responsible for any transactions made with non-affiliated companies through our website.
11. Confidentiality & privacy
The use of the bid-dream.com site and/or its services is regulated by our Policy of Confidentiality and Privacy which can occasionally change. Any change will be published on the site. Our Policy of Confidentiality and Privacy is regarded as integral part of this Agreement. Should you disagree with our Policy of Confidentiality and Privacy, please refrain from using our site.

The « terms of use » are regarded as integral part of this agreement and by using this site, you accept, without condition these « terms of use » in their entirety and without any exception. Should you disagree with our terms of use, please refrain from using our site.
13. Clause of responsibility & exemptions.
Bid-dream.com and/or Pure Move SA, including its legal representatives, administrators, directors, agents, associated companies and employees are not responsible for the incorrect or incomplete contents published on the site or in relation with the Service, which may be caused by users, equipment, software issues or programs associated with the site.
Bid-dream.com does not assume any responsibility for the errors, omissions, interruptions, defects, delays in the operations of the site due to external causes.
Bid-dream.com declines any responsibility for any problem or faulty technical operation caused by telecommunication networks or phone line, user's computer system and softwares or Internet access provider, computer hardware, software, missmanaged emails or internet traffic congestion or any combination of those. Under no circumstances Bid-dream.com should be held responsible for any loss or damage due to the use of its site.
14. Limitations of the Responsibility
Under no ciscumstances should any compensation to user exceed the amount paid by said user.
15. Arbitration
This agreement was written in accordance with French & European laws. Any litigation should be commenced in France using the appropriate channels of the French judiciary system.
Should arbitration be decided upon, both parties agree to split equally such costs to the exception of any attorney fees.

If communications are to be addressed to user :
The company will use the contact information provided by the user at the time of the subscription. The company shall not be held liable or responsible should that information be incorrect, resulting in the return of written communications to bid-dream.com.
When sent by email, the communication will be determined RECEIVED as soon as it is sent, unless it is returned undeliverable by the user's ISP or the system.
Each users who have subscribed and registered on the bid-dream.com site have read, accepted and digitally approved and signed, without conditions, all the terms and donditions of use stated in the agreement, the terms of use as well as the Policy of confidentiality and privacy as integral part of the overall terms & conditions of use.

The terms of use (or "Rules") stated in this agreement, govern all bids and action of bidding, on the bid-dream.com site. Those are also integral part of the terms and Conditions of use as well as the agreement.
General information
You understand this site offers the opportunity to buy services or products at a very low price through a reverse auction system. The « winner » must have the single lowest bid on the item in order to win it.
Definitions
Procedure To win an auction/buy the product
The winner of the bid is the user with the LOWEST bid, bid that was made by NO OTHER user (single lowest bid). Should the winner not be able to confirm the purchase within the time period alloted to claim the win, the new winner will be the second lowest single bid. Should the second winner not claim the win, the product will be declared UNSOLD and put back up for a new auction.
How to bid
To make a bid, you must be a registered user and have enough credits. For each auction or product, bid-dream.com indicates the number of credits needed. Credits used for the auction or the bid will be deducted from the user's account.
Delivery of the win/product.
After winning the bid, user has 14 (fourteen) days to come forward and claim the win as well as establish travel dates for the destination won. The winner has 6 months to travel. Should unforeseen events occur, bid-dream.com, although under no obligation, may allow an exception and extend the deadline to travel. User may also choose a 3rd party recipient who will receive the win. Should the winner not select a travel date within the required period, bid-dream.com reserves the right to select such date for the winner. The winner will be informed of such dates by e-mail and will have to provide an answer within 48 hours. Should the winner fail to answer within the alloted time, bid-dream.com and/or Pure Move SA will assume the winner has accepted the travel dates. Once the contract between the winner and the tour operator/travel provider has been drafted, signed and paid for by bid-dream.com in accordance to the terms of the auction, bid-dream will no longer be involved in further negotiations/arrangements and changes. Once the trip is paid for, the winner AND the tour operator/travel provider must communicate with each other without further involvment on the part of bid-dream.com. Bid-dream.com can't be held legally liable or responsible for any disagreement or issues that may arise from the dealings between the winner and the tour operator/travel provider. However, it promises to assist with any mediation that could possibly resolve any issue at hand.
Availability
Bid-dream.com does its best to ensure product availability through its tour operators/travel providers partners. When a product is put up for auction, it is assumed it is available. However, things could change during the confirmation period after the win (i.e the provider could run out of business or the destination could become unsafe for travelers). In such case, bid-dream.com promises to provide a product of similar or higher value.

However, it does not assume liability or responsibility for mis-interpretation on the part of the user. In doubt, please make sure to contact our customer service department with your questions. - "The single lowest bid": The single lowest bid is defined as being the lowest AND UNIQUE bid on the service or product. It is expressed in Euro and centimes, it is the bid the closest to 1 centime of Euros (0,01€) and which was ONLY placed by one user and no other use.
- "Product" or "Batch": a specific and individual product which is put up for auction on the bid-dream.com site.
- "Bid": indicate the amount which the user is willing to auction the produc tat. It may also be defined as OFFER or PURCHASE OFFER.
- "Blind bid": Blind Bid means that you do not have the possibility of knowing what the other users have offer for the produc tat auction. The bids remain confidential until the auction is completed. You will only be able to see the twenty (20) values around the bid that you have just placed (10 under and 10 over). You will also know whether or not your bid is:

- "Bid duration": indicates the duration during which bids can be placed on the auction. This « duration » is indicated by a countdown on the screen.
- "Bid winner": indicate the user who won the product.
- "Credits": the credits are used to complete the bids. Each bid requires a certain amount of « credits ».
